Under the provisions of the Complaints against the FSA Scheme (Amendment No. 2) Instrument 2005, the FSA, having been informed of a conflict of interest on the part of the Complaints Commissioner, requested the President of the Law Society to nominate a Solicitor to act as Independent Investigator to consider and report on complaints made against the Financial Services Authority (FSA) in their handling of the matter of an alleged collective investment scheme and Y Life Pension Mortgage and Insurance Services.

Mr David Simpson was so nominated, on this occasion, by the President on 1st November 2005. He is a Solicitor and part time member of the Judiciary and had no previous interest or involvement in these matters. The nomination was approved by the Treasury and Mr Simpson carried out the functions conferred on the Complaints Commissioner by the Complaint Scheme, which is established in accordance with Paragraph 7 of Schedule 1 to the Financial Services and Markets Act 2000 and generally referred to as Complaints against the FSA [COAF]. Mr Simpson’s appointment to the role of Independent Investigator was solely for the two cases listed below and upon the publication of the reports his appointment to the role ended.
